Nanny Cam Laws You Should Be Aware Of

In my article where I listed some medium priced nanny cams and some cheap nanny cams, I gave a basic overview of nanny cam laws. However, I think it is important that I provide this resource for you so you can be well informed about the laws concerning nanny cameras in your state.

There are 3 laws that you need to be aware of. ​

Nanny Cams Are Legal In All 50 States

The first thing you should know is that using a nanny cam even a hidden spy camera is legal in all 50 states as long as you are recording video only. This comes with a couple of caveats that I will list below but in normal situations, you are covered legally if you are using a hidden nanny camera.

Nanny Cameras Cannot Be Used In Bathrooms Or Your Nanny's Bedroom​

You absolutely cannot use a hidden or a visible nanny cam in your nanny's bedroom or the bathrooms of your house. Videoing anyone is a compromising position while eliminating bodily waste or while undressing and dressing is a violation of privacy laws in all 50 states and in some cases is considered a sex crime.

​Some States Have Laws Against Recording Audio With A Nanny Cam

There are 15 states that regulate the recording of people without their consent. The States that do not allow you to record audio at the time of this writing are as follows.

  • California
  • Connecticut
  • Delaware
  • Florida
  • Hawaii
  • Illinois
  • Louisiana
  • Maryland
  • Massachusetts
  • Montana
  • Nevada
  • New Hampshire
  • Oregon
  • Pennsylvania
  • Washington

You must get your nanny's permission prior to recording her with audio. Make sure you get this permission in writing and if possible in front of your nanny cam. Make sure you store these records in a safe place.
